What applies to your building from 2027.
The Building Modernisation Act (GModG) replaces the previous Buildings Energy Act on 1 January 2027 and transposes the EU Energy Performance of Buildings Directive (EPBD) into national law — with direct relevance for lighting design in non-residential buildings.
Mandatory Automatic Lighting Control (§ 56 (6))
Buildings with sufficiently large heating, cooling or ventilation systems will require zoned, automatic lighting control with at least occupancy detection — including data exchange with other building systems as well as consumption monitoring and logging.
- System output > 290 kW: Implementation already mandatory in Germany since 31 Dec 2024
- System output > 70 kW: Implementation required by 31 Dec 2029 at the latest
Which buildings are affected?
Reference values for the floor area at which the 70 kW threshold is typically reached:

In addition: Minimum Energy Performance Standards (MEPS)
From 2030, all non-residential buildings must fall below the 16 % energy consumption threshold, and below 26 % from 2033 — with no grandfathering. The exact enforcement framework is still being finalised; the obligation for automatic lighting control remains unaffected by this.
In addition, many affected companies are subject to an energy audit obligation: mandatory every four years for non-SMEs under § 8b EDL-G, voluntary for SMEs and eligible for BAFA funding under "Energy Consulting for Non-Residential Buildings, Systems and Equipment" (EBN). Switching to LED lighting with intelligent control already brings many buildings below the relevant thresholds — and can reduce lighting energy costs by up to 80 %. It pays to check early whether your building reaches the 70 kW threshold.
